These Terms and Conditions (“T&C”) establish the legally binding framework between You (“User,” “Traveler,” or “Customer”) and Tripsiana (referring to the legal entity operating the brand Tripsiana, headquartered in Delhi, India). These terms apply to all bookings made through our website, mobile applications, social media channels, or offline sales offices.
By engaging our services, making a payment, or receiving a booking voucher, You confirm that you have read, understood, and agreed to these T&C in their entirety.
1. DEFINITIONS AND INTERPRETATION
- “Tripsiana”: The travel management company acting as an organizer and facilitator of travel services.
- “Services”: Includes but is not limited to flight bookings, hotel accommodations, land transfers, visa assistance, curated activities, and insurance.
- “Booking Voucher”: The final confirmatory document issued by Tripsiana detailing the locked-in itinerary and inclusions.
- “Suppliers”: Third-party entities (Airlines, Hotels, Transport Providers, Ground Handlers) that provide the actual service.
2. CONTRACTUAL BINDING & DOCUMENTATION
- The Finality Clause: While we provide itineraries and quotations during the planning phase, the Booking Voucher issued after payment is the only document that constitutes the final contract. Any service not explicitly mentioned in the “Inclusions” section of the Final Voucher will not be provided.
- Communication: Information shared via social media, WhatsApp, or phone calls is for informational purposes only. In the event of a conflict between a verbal conversation and the written Booking Voucher, the written Booking Voucher shall prevail.
- Accurate Information: The User is responsible for providing names exactly as they appear on passports/IDs. For international travel, any cost arising from name corrections after ticket issuance shall be borne solely by the User.
3. PRICING & CURRENCY FLUCTUATIONS
- International Bookings: For international packages, prices are often quoted based on a specific Rate of Exchange (ROE) of the Foreign Currency against the Indian Rupee (INR). Tripsiana reserves the right to adjust the final price if the ROE fluctuates significantly between the date of the quotation and the date of final payment.
- Dynamic Pricing: Flight and hotel prices are dynamic. A quotation is only valid at the moment of issuance and is subject to change until a formal booking is processed with a deposit.
4. PAYMENTS & FINANCIAL OBLIGATIONS
- Payment Schedule: A booking is only considered “confirmed” once the initial deposit (as specified in the quotation) is received.
- TCS & GST: As per Indian Law, Tax Collected at Source (TCS) is mandatory for all international travel. Users must provide a valid PAN card. GST is applicable as per current government slabs for domestic and international tours.
- Late Payments: Failure to clear the balance payment by the specified deadline may result in the automatic cancellation of the booking. In such cases, the initial deposit will be forfeited.
5. CANCELLATIONS & REFUND POLICY
Tripsiana acts as a coordinator between you and various suppliers. Refund amounts are subject to the specific policies of these suppliers (Airlines/Hotels/Transporters).
- Standard Cancellation Scale:
- 45+ Days before departure: 25% of the total package cost (non-refundable deposit) + any non-refundable flight/visa fees.
- 44 – 30 Days: 50% of the total package cost.
- 29 – 15 Days: 75% of the total package cost.
- Less than 15 Days / No Show: 100% of the total package cost.
- Processing Time: Refunds, once approved, may take 15–30 business days to reflect in the original payment source, depending on bank and supplier timelines.
6. VISA AND TRAVEL PERMITS
- Facilitation Role: Tripsiana acts only as a facilitator for visa applications. The decision to grant or reject a visa rests solely with the respective Embassy/Consulate.
- Visa Rejection: A visa rejection does not waive the cancellation terms of the tour package. If a visa is denied, the cancellation charges mentioned in Section 5 will remain applicable.
- Transit Visas: It is the User’s responsibility to check and obtain transit visas for layovers. Tripsiana is not liable for boarding denials due to lack of transit documentation.
7. LIMITATION OF LIABILITY (THE SHIELD)
- Independent Suppliers: Tripsiana does not own or control the airlines, hotels, or transport companies. We are not liable for service deficiencies, delays, mechanical breakdowns, or strikes caused by these independent suppliers.
- Force Majeure: Tripsiana is not liable for any loss, delay, or damage caused by “Acts of God” (weather, natural disasters), government restrictions, war, or pandemics. Any additional costs incurred during such events (e.g., extra nights at a hotel) are the responsibility of the traveler.
- Maximum Aggregate Liability: The total liability of Tripsiana for any claim arising out of the services shall be limited to the Service Fee/Management Fee charged by Tripsiana, and in no case shall it exceed the total amount paid by the User for that specific booking.
8. DISPUTE RESOLUTION & JURISDICTION
- Reporting Deadline: Any service-related grievance must be reported to our support team within 24 hours of the occurrence while on the trip. A formal written complaint must be submitted within 5 days of the trip completion. Claims submitted after this period will be considered waived.
- Governing Law: These terms are governed by the laws of India.
- Exclusive Jurisdiction: All disputes are subject to the exclusive jurisdiction of the courts in New Delhi only.
9. USER CONDUCT & SAFETY
- Compliance: Travelers must abide by the local laws of the destination country/state. Tripsiana is not responsible for legal consequences arising from the traveler’s misconduct.
- Health & Insurance: We strongly advise all travelers to purchase comprehensive travel insurance. Travelers must ensure they are medically fit for the activities (e.g., trekking, scuba diving) included in their itinerary.
Refinements for a Global Startup:
- ROE (Rate of Exchange) Clause: Crucial for international trips. It prevents you from losing money if the Rupee drops against the Dollar/Euro after you give a quote.
- Service Fee Cap: Instead of being liable for the whole 5 Lakhs (for example) a client paid, this clause attempts to limit your liability to the profit/fee you made.
- Transit Visa Warning: Many travelers blame agencies when they are stopped at layover airports (like Dubai or Singapore). This shifts the responsibility to them.
- 24-Hour Reporting: This ensures that if a hotel is bad, they tell you then, giving you a chance to fix it, rather than them complaining after the trip is over to get a discount.
